Postwork, Inc. ("Postwork," "we," "us," or "our") operates a freelancer marketplace that connects clients with freelancers, available through our website and our desktop application (collectively, the "Services").

This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. By using the Services, you agree to the collection and use of information in accordance with this policy.

Information you provide to us

• Account information. When you create an account, we collect your name, email address, and authentication details. If you sign up through a third-party provider such as Google, we receive basic profile information from that provider.
• Profile information. Freelancers may provide a photo, skills, work history, portfolio items, hourly rates, and other professional details. Clients may provide company information and job postings.
• Payment information. Payments and payouts are processed by our payment processor, Stripe. We do not store full payment card numbers or bank account credentials on our servers.
• Communications. Messages sent through the Services, job applications, contract details, and correspondence with our support team.

Information collected automatically

• Usage data. Log data such as IP address, browser type, device information, operating system, pages viewed, referring pages, and the dates and times of your visits.
• Cookies and similar technologies. See the "Cookies and Tracking Technologies" section below.

Work session data (opt-in)

Freelancers who choose to participate in our data collection program use our desktop application to record their work sessions. With their explicit consent, this may include screen recordings, active application and window information, and input activity captured while a recording session is running. Recording occurs only when the freelancer starts a session, and participants are compensated for the data they share.

• Provide, operate, and maintain the Services, including matching clients with freelancers;
• Process contracts, payments, invoices, and payouts;
• Verify identity, prevent fraud, and maintain the safety and integrity of the Services;
• Communicate with you about your account, transactions, and updates to the Services;
• Send marketing communications, where permitted by law, which you can opt out of at any time;
• Measure and improve the performance of our advertising campaigns;
• Analyze usage to improve and develop the Services;
• Train and improve artificial intelligence models using work session data collected from participants who have explicitly opted in; and
• Comply with legal obligations and enforce our agreements.

We and our partners use cookies, pixels, and similar technologies to operate the Services, remember your preferences, analyze traffic, and measure and improve advertising. These include:

• Meta Pixel. We use the Meta (Facebook) Pixel to measure the effectiveness of our advertising on Meta platforms, build audiences for our ads, and understand how visitors interact with our website. Meta may associate this data with your Meta account in accordance with its own data policy.
• Analytics. We use analytics providers such as PostHog and Vercel Analytics to understand how the Services are used.

You can control cookies through your browser settings. You can manage how Meta uses your data for ads through your Meta ad preferences, and opt out of certain interest-based advertising at optout.aboutads.info. Disabling cookies may affect some features of the Services.

We share information in the following circumstances:

• Between clients and freelancers. Profile details, job postings, applications, and contract information are shared between the parties as necessary to operate the marketplace.
• Service providers. We share information with vendors who perform services on our behalf, such as authentication (Clerk), payment processing (Stripe), cloud hosting and storage, analytics, and advertising partners. These providers are only permitted to use the information to perform services for us.
• AI training partners. Work session data from freelancers who have explicitly opted into our data collection program may be licensed to third parties for the purpose of training AI models. Before sharing, this data is processed to remove or obscure sensitive personal information.
• Legal requirements. We may disclose information if required by law, subpoena, or legal process, or to protect the rights, property, or safety of Postwork, our users, or others.
• Business transfers. If Postwork is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

We retain personal information for as long as your account is active or as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete it or de-identify it.

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and access controls. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Depending on where you live, you may have the right to:

• Access the personal information we hold about you;
• Correct inaccurate or incomplete information;
• Request deletion of your personal information;
• Receive a copy of your information in a portable format;
• Object to or restrict certain processing of your information; and
• Withdraw consent where processing is based on consent, including participation in our data collection program.

Postwork is based in the United States, and your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. Where required, we use appropriate safeguards for such transfers.

The Services are not directed to individuals under 18, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, by additional notice such as email or an in-product message. Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
